Medical Weight Loss Solutions recognizes the importance of telehealth services as a crucial component of the US healthcare system. However, we understand that certain limitations may exist in the communication between healthcare providers and patients. For this reason, it is critical to maintain ethical and high standards in practice to ensure quality of care and compliance with legal requirements. Medical Weight Loss Solutions adheres to the following policies to preserve the integrity of our telehealth services:

1. Licensing Compliance

All providers, doctors, nurses, and other such practitioners affiliated with Medical Weight Loss Solutions are licensed and/or registered in good standing to engage in the practice of medicine and/or nursing in all jurisdictions in which they reside, and in jurisdictions in which they practice or render services to (such as the patient’s jurisdiction), except in circumstances allowed by law.

2. Controlled Substances Practices

All providers, doctors, nurses, and other such practitioners affiliated with Medical Weight Loss Solutions are licensed maintain an up to date and valid US Drug Enforcement Administration (DEA) license and any requisite state licenses as per state or local law. Controlled substances are only prescribed when a clear medical need exists that cannot be adequately met by the use of a non-controlled substance in the provider’s professional opinion.

Due to the complex nature of pain and the necessity for extremely thorough monitoring greater than telehealth can provide, no providers, doctors, nurses, and other such practitioners affiliated with Medical Weight Loss Solutions prescribe or dispense prescription pain medication (opiates and/other narcotics) through telemedicine.

We do not, nor are we able to, facilitate the dispensing or prescribing of prescription pain medication (opiates and/other narcotics). If you suffer from pain, please see a local specialist and verify their licensing with the your local board of health.

3. Provider Quality & Disciplinary Actions

All providers, doctors, nurses, and other such practitioners affiliated with Medical Weight Loss Solutions or to which patients are referred to are free from any significant recent and/or repeated disciplinary actions, sanctions, or similar. Medical Weight Loss Solutions requires all affiliated providers to immediately notify our team in the event an affiliated provider is subject to any of the above actions.

4. Telemedicine & Establishing a Provider-Patient Relationship

All providers, doctors, nurses, and other such practitioners affiliated with Medical Weight Loss Solutions conduct a full telehealth review before establishing a diagnosis, or the writing and/or dispensing of any medication. A prescription will only be provided when a:

a) The patient has a legitimate medical complaint;

b) A face-to-face physical examination adequate to establish the legitimacy of the medical complaint has been performed by the prescribing practitioner, or through a telemedicine practice approved by the appropriate practitioner board; and

c) A logical connection exists between the medical complaint, the medical history, and the physical examination and the drug prescribed.

This definition establishes the bare minimum standards, and all providers, doctors, nurses, and other such practitioners affiliated with Medical Weight Loss Solutions follow all applicable federal, state, and local laws regarding the practice of telehealth as required.

5. Legal Compliance

All providers, doctors, nurses, and other such practitioners affiliated with Medical Weight Loss Solutions comply fully with state laws and regulations; the Federal Food, Drug, and Cosmetic Act; and the Federal Controlled Substances Act. We do not facilitate the prescribing or dispensing of, or offer to facilitate the prescribing or dispensing of, any commercial medications that have not been approved by the US Food and Drug Administration (FDA). Compounded medications are exclusively compounded at licensed 503(a) compounding pharmacies pursuant to Section 503A of the Federal Food, Drug, and Cosmetic Act.

6. Privacy

The transmission of any information that would be considered Protected Health Information (PHI) under the HIPAA Privacy Rule (45 CFR 164) is in accordance with HIPAA requirements, including the use of Secure-Socket Layer or equivalent technology for the transmission of PHI, and for any online transmissions.
